Terms of Service/Purchase Waiver of Liability
I understand this payment is non-refundable and non-transferable. By signing below, I am agreeing to pay Kat McGee, service provider Kat McGee for coaching and/or yoga services.
BY MAKING PAYMENT FOR SERVICES THE CLIENT IS AGREEING TO THE FOLLOWING: Parties agree that the participation in any and all subscriptions, classes, sessions and/or programs, virtually and/or in person is in the nature of mentoring, coaching, and education and/or yoga, meditation, physical fitness and well being practices. The scope of services rendered by (Company) Kat McGee Yoga & Transformational Coaching Inc. and its other principals, owners, LLC members, employees, agents, independent contractors, and representatives and service provider Kat McGee pursuant to this contract shall be solely limited to those contained therein and provided for by Kat McGee as part of the individually structured program or group structured program.
Company and service provider reserves the right to substitute services equal to or comparable to originally purchased services for Client if the need arises. If client cancels attendance for any reason whatsoever, Client will receive no refund.
DISCLAIMER OF GUARANTEE. Client accepts and agrees that she/he is 100% responsible for her/his progress and results from participation in subscriptions, classes and/or programs. Client accepts and agrees that she/he is the one vital element to their success and that Company cannot control Client.
Client understands that it takes time and a strong commitment to change habits of thinking and acting, and that Client is 100% committed to making a concentrated effort to his/her own progress to obtain results from any health, fitness and/or well being program. Company and service provider makes no representations or guarantees verbally or in writing regarding performance of this Agreement other than those specifically enumerated herein.
Company, service provider and its affiliates disclaim the implied warranties of titles, merchant ability, and fitness for a particular purpose. Company and service provider makes no guarantee or warranty that subscriptions, classes and/or programs will meet Client's requirements or that all clients will achieve the same results. NO SUBSTITUTE FOR MEDICAL TREATMENT. Client agrees to be mindful of his/her own well-being during the fitness, yoga, well being and/or transformational coaching process and seek medical treatment (including but not limited to psychotherapy), if needed. Company and service provider does not provide medical, therapy, or psychotherapy services. Company is not responsible for any decisions made by Client as a result of the coaching and/or yoga training process and any consequences thereof. Company reserves the right at any time to modify or discontinue the service (or any part or content thereof) without notice.
Client acknowledges the following:
Assumption of Risk - I am participating with Kat McGee and in Kat McGee Yoga & Transformational Coaching Inc. Programs and/or Yoga, Coaching, Training, Well Being Programs and with any/all of it's affiliates, independent contracts and/or guest teachers, of my own free will. I understand that my decision to participate in subscriptions, classes and/or programs is entirely voluntary and is not a requirement. I assume full responsibility for all risks that may arise out of, or result from my participation.
Waiver of Liability - I am solely responsible for any injury or damage sustained, whether for personal or bodily injury, property damage, death, sickness or otherwise as a result of my participation in any/all subscriptions, classes and/or programs, the performance of physical fitness and yoga exercises, all offered well being practices, equipment and instructors/guest teachers and/or any actor omission of Kat McGee, Kat McGee Yoga & Transformational Coaching Inc. resulting from negligence or otherwise (herein after “Released Items”). Kat McGee, Kat McGee Yoga & Transformational Coaching Inc. and its other principals, owners, LLC members, employees, agents, independent contractors, guest teachers and representatives (herein after “Releases”) will be held harmless and shall defend and indemnify each of the Releases of and from any and all claims, losses, injuries and/or damages to persons and/or property which may arise from or be related to any of the Released items. I hereby waive any protections afforded by any statute or law in any jurisdiction whose purpose, substance and/or effect is to provide that a general release shall not extend to claims, material or otherwise which the person giving the release does not know or suspect to exist at the time of executing the release. This means, that I am releasing unknown future claims.
This Assumption of Risk, Waiver, and Release of Liability shall be governed in all respects by the laws of the State of California. The parties agree to use the State of California for Jurisdiction and the County of Los Angeles as Venue for any disputes between the parties related to this Assumption of Risk, Waiver, and Release of Liability.
I have read and fully understand this Assumption of Risk, Waiver, and Release of Liability and understand that it relates to surrendering and releasing valuable legal rights. I do so freely and voluntarily.
